These Terms of Service (“Terms”) govern your access to and use of Fluentsmith, available at fluentsmith.com (the “Service”), operated by Nimbus Labs (“we,” “us,” or “our”). By using Fluentsmith, you agree to these Terms. If you do not agree, do not use the Service.
1. Acceptance of Terms
By accessing or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
2. Description of the Service
Fluentsmith is an AI-powered text rewriting tool. You submit text, choose a tone (and, on paid plans, a language), and the Service generates a rewritten version of that text. The Service is provided over the internet and may change as we improve features, availability, and performance.
3. Free Tier and Fluentsmith Pro
Free tier. No email or account is needed. You can make 1 rewrite per day, in English. The limit is counted per browser and resets at midnight UTC. A single internet connection also has a daily ceiling of 25 free rewrites in total, so that one network cannot be used to farm the free tier. Free-tier limits may change from time to time.
Fluentsmith Pro costs USD 19 per month (a subscription that renews automatically each month until canceled). The final total, currency, and applicable taxes are shown at checkout. It includes unlimited rewrites — there is no daily limit — all 5 tones, 6 output languages (English, Spanish, Portuguese, French, German and Italian), and up to 6,000 characters per rewrite. Requests above 20 per minute may be temporarily limited to protect service availability. This does not introduce a daily Pro allowance.
Cancellation. You may cancel at any time. After cancellation, Pro remains active until the end of the period you have already paid for, unless that payment is fully refunded or charged back. Cancel on Billing & support after verifying your purchase email. You can also use the link in your Paddle receipt or Paddle payment support. Deleting cookies or stopping use of Fluentsmith does not cancel a subscription. Cancellation does not itself request a refund. If a renewal payment fails, Paddle retries it; Pro stays active while Paddle is retrying and ends if the subscription is canceled.
If we shut Fluentsmith down. Fluentsmith Pro is a monthly subscription. If we decide to close the Service we will email every active subscriber at least 30 days in advance and stop charging from that notice onward. If we cannot provide a period you have already paid for, contact us or Paddle about the unused paid service. Your statutory rights are not affected.
Refunds and chargebacks. If a payment is refunded in full or charged back, the Pro access it paid for ends.
4. Who You Are Buying From
Fluentsmith Pro is sold by Paddle, not by Nimbus Labs. Paddle is our authorized reseller and the merchant of record for every Fluentsmith Pro purchase. This is worth reading before you buy, because it changes who you are actually contracting with.
What that means in practice:
- Your contract of sale for Fluentsmith Pro is with Paddle. Which Paddle company that is depends on where you buy from — Paddle.com Inc. in the United States, Paddle.com (Canada) Ltd. in Canada, and Paddle.com Market Limited, registered in England and Wales, in the rest of the world. Paddle’s Buyer Terms and Privacy Notice apply to that purchase, alongside these Terms, which govern your use of the Service itself.
- Paddle charges you, issues your invoice, and collects and remits any sales tax or VAT that applies where you live. We do not handle that.
- Paddle, not Nimbus Labs, will normally be the name that appears on your card or bank statement.
- Paddle runs the billing, renewals, and cancellations, and offers its own buyer support and refund process. You can also write to us and we will help — see our Refund Policy.
We never see or store your full card number. Nothing in this section takes away any right you have under the consumer-protection law of your own country.
Fluentsmith Pro covers Fluentsmith only. Other Nimbus Labs products have separate plans and terms. Keep your purchase email and receipt: restoring access on another browser requires proof of purchase. Price changes for existing subscriptions are subject to notice and any consent required by applicable law and Paddle’s terms.
5. Acceptable Use
You agree not to use the Service to:
- Submit, generate, or request illegal, harmful, or infringing content
- Abuse, overload, or interfere with the Service, including automated scraping, excessive requests, or attempts to bypass rate limits
- Reverse engineer, copy, or resell the Service except as permitted by law
- Misrepresent the origin of generated text in a way that is deceptive or unlawful
We may suspend or terminate access if we reasonably believe you have violated these Terms or abused the Service.
6. Intellectual Property
You retain ownership of the text you submit and of the rewritten output generated for you, to the extent permitted by applicable law. You grant Nimbus Labs a limited license to process that text solely to provide the Service.
Nimbus Labs and its licensors own the Service itself, including the Fluentsmith name, website, software, design, and related intellectual property. These Terms do not transfer any ownership of the Service to you.
7. Disclaimer of Warranties
The Service is provided “as is” and “as available.” Rewritten text is generated by artificial intelligence and may be inaccurate, incomplete, or unsuitable for your purpose. We do not warrant that the Service will be uninterrupted, error-free, or that outputs will meet your requirements. Review names, amounts, dates, deadlines, and commitments before using any result; a rewrite does not verify the underlying facts. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
8. Limitation of Liability
To the fullest extent permitted by law, Nimbus Labs and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount paid for the Service in the 12 months before the claim, or USD 50, whichever is greater. These limits do not exclude liability that cannot lawfully be excluded or restrict mandatory consumer remedies.
9. Changes to These Terms
We may update these Terms from time to time. The updated version will be posted on this page with a revised “Last updated” date. Continued use of the Service after changes take effect is subject to the updated Terms, to the extent permitted by law. Material changes affecting an active paid subscription will be communicated where required, without removing rights already accrued.
10. Governing Law
Applicable law determines the law and courts with jurisdiction over disputes about this Service. These Terms do not restrict mandatory consumer protections or any right to bring a claim before the courts of the country where you live. Your purchase of Fluentsmith Pro is a separate contract with Paddle and is governed by Paddle’s own terms, as described in section 4.
